We are all Socialist now; part III

The Supreme Court has made the Constitution worthless. It has more value if you were to wipe your ass with it. The Supreme Court did not hear Indiana Pensioners appeal of bankruptcy in the Chrysler case.

Where is the ‘rule of law’?

That brings me to a point that needs to be made. Do you know what the ‘rule of law’ is? When you hear ‘rule of law’, it means the Constitution. This is right out of George Orwell’s Animal Farm. The ‘rule of law’ is for WE THE (little) PEOPLE. But Napoleon and the Pigs can sleep in the bed.

Know your rights! If you don’t know the Constitution, you don’t know the law!

The Fifth Amendment
No person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

You hear the Fifth Amendment and you think it’s time to shut up in court or Congressional hearing. Read it again. pay attention to the last part of it. “nor be deprived of life, liberty, or property, without due process of law”.

Bankruptcy law states if a debtor defaults on payment, a senior secured creditor has the contractual right in bankruptcy to demand his collateral, or the cash value of his collateral. This is important because a loan secured by collateral is safer than a loan that’s unsecured. Because the loan is safer, a lender can charge a lower interest rate to the debtor. Chrysler received lower interest rates from its secured creditors in exchange for pledging its property as collateral.

The Obama Administration extorted the collateral from the senior secured creditors in the Chrysler case, with threats and intimidation of besmirchment with the Whitehouse Press Corp. Bankruptcy law is clear that those creditors are to be protected.

This changes the way business is run. The rules will made up as Obama sees fit. The Supreme Court has just given him free reign. As a business owner, and that includes small and home based businesses, your security is no longer secure. We now live in a socialist country. Your property is no longer yours.

    It is outrageous. The sale of Chrysler to Fiat was just rammed through. Where was discussion or a hearing on it? Good post my Fox.
